GENERAL TERMS AND CONIDITIONS

 

The following General Terms and Conditions (“terms and conditions”) shall apply to all orders made by the customer. Please, make sure you have read these terms and conditions carefully before submitting your order.

 

ORDERS

Orders are realized through the e-shop. After placing the order, you will receive an email confirmation of its receipt together with information on the expected delivery details. In case we are unable to process your order, we will inform you immediately about the reasons and the solution. If the purchase price has already been paid, we will refund it in full.

 

DELIVERY AND RETURNS

DELIVERY

Once you have placed your order you will receive an email confirmation with your expected delivery details. 

The seller delivers the ordered goods according to size and weight through the transport company selected by the seller. The ordered goods will be sent to the buyer according to the availability of products and operational capabilities of the seller in the shortest possible time, usually within 2 to 8 working days from the date of delivery of the binding order, respectively. payment of the purchase price (in the case of payment by bank transfer), in exceptional cases the delivery time may be longer, and the buyer will be informed of this fact in a timely manner by e-mail or telephone. The delivery of the goods to the address specified by the buyer in the binding order is considered to be the proper equipment of the delivery of the goods. The goods are transported to the destination address. The consignment with the goods contains a tax document (invoice), which also serves as a guarantee certificate. When taking over the goods from the transport company, the buyer is always obliged to thoroughly check the integrity of the packaging and whether the shipment shows obvious signs of damage. If it is found that the packaging of the goods is damaged, the buyer is obliged to include this information in the acceptance protocol of the transport company. Ownership of the goods passes to the buyer, provided that the purchase price is paid, at the time of its receipt. The risk of damage to property passes through the takeover of the goods by the buyer.

 

WITHDRAWAL OF THE ORDER

If the item you have received is defective, please notify AKAT studio promptly and return the item in accordance with section RETURNS below. AKAT studio will, for any products deemed defective, provide a full refund, including the costs of delivery and return. The provisions set forth herein do not limit any applicable statutory rights.

 

RETURNS

 

The conditions for withdrawal from the contract by the buyer, who is a consumer, are governed by the relevant provisions of Act no. 40/1964 Coll. Of the Civil Code as amended, Act no. 250/2007 Coll. on consumer protection as amended and Act no. 102/2014 Coll. on consumer protection in the sale of goods or provision of services on the basis of a contract concluded at a distance or a contract concluded outside the premises of the seller and on the amendment of certain laws as amended. The consumer has the right to withdraw from the contract within 14 days of receipt of the goods. If he decides to withdraw within this period and complies with the conditions below, the purchase price will be refunded. This right does not serve as a way of resolving the complaint. If the buyer decides to withdraw within this period, he is obliged to comply with the conditions below.

The returned items need to be undamaged, without signs of use, complete (including accessories) and, if possible, with the original packaging and proof of purchase (or a copy). In the case of consumer goods (eg car cosmetics, liquid products, etc.), then it is possible to withdraw from the contract only if the buyer delivers the goods undamaged and unused in undamaged original packaging. The goods may not be sent cash on delivery when returned, but the buyer is advised to insure the goods. The money for the goods will be returned to the buyer by transfer to his account, within 15 working days after the physical receipt and inspection of the goods by the seller, but no later than 30 days from delivery of the written withdrawal from the contract to the seller. If the value of the goods has been reduced (if the goods have been partially consumed or worn, the goods are incomplete or damaged), the buyer is obliged to pay the seller the amount by which the value of the returned goods was reduced - in which case the seller is entitled to unilaterally set off its claim. Against the buyer's receivable for a refund of the purchase price. This means the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or tags should be intact.

WARRANTY

The seller is responsible for defects that the sold goods have when taken over by the buyer and for defects that occur after taking over the goods during the warranty period. The warranty period is 24 months. For items sold at a lower price due to a defect, the warranty period is 24 months, but the seller is not responsible for the defect for which a lower price was agreed. For used items (eg demonstration model), the seller is not responsible for defects caused by their use or wear. In this case, the warranty period is 12 months.

 

The buyer is obliged to visually inspect the goods immediately upon or after receipt. The buyer is entitled not to accept the goods if there is visible mechanical damage on it or on its packaging, obviously caused by transport or if the goods are incomplete. In such a case, he is always obliged to write with the employee of the seller and / or the transport company that ensured the delivery of the goods, a report on the damage / claims and refuse to accept the shipment. Mechanical damage to the product in undamaged packaging must be reported immediately upon receipt of the shipment and the product must not be used. Subsequent complaints of this nature may not be accepted with regard to the carrier's complaint conditions.

 

If there are defects in the goods you have purchased, AKAT studio abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form. The goods can be brought to our store on Nedbalova 10, 81101 Bratislava or can be shipped to the same address.

 

The seller is obliged to determine the method of handling the complaint and to handle the complaint within a period which may not be longer than 30 days from the complaint. In the case of a complaint filed within 12 months from the purchase of the product, the seller may handle the complaint by rejection only on the basis of professional judgment. If the seller rejects the complaint made after 12 months from the purchase of the product, the seller is obliged to inform the buyer to whom the product can be sent for professional assessment in accordance with the Consumer Protection Act. For the purposes of handling complaints, professional assessment means o. i. as well as the opinion of the authorized person or the person authorized by the manufacturer to carry out warranty repairs.

The seller is obliged to issue a confirmation to the customer when making a complaint. This confirmation is a copy of the complaint protocol. If the customer has lodged a complaint by means of long-distance communication, the seller is obliged to deliver the confirmation of the complaint to the consumer without undue delay by e-mail, if he is aware of it. In the event that the customer is informed about the method of handling the complaint:

  • before the expiration of the 30-day period, the seller is entitled to inform the customer about the method of handling the complaint;
  • after the expiration of the 30-day period, the seller is obliged to inform the customer about the method of handling the complaint and the reason why the complaint was not resolved in time.

The seller is obliged to issue a written document on the handling of the complaint no later than 30 days from the date of the complaint. This written document is a copy of the complaint protocol with the completed field of complaint handling or a letter containing a written notice of complaint handling.

If an irreparable error of the goods is found, the goods will be exchanged for the same goods according to the buyer's request, or the purchase price already paid will be refunded. In the case of a justified complaint, the buyer has the right to reimbursement of his purposefully incurred costs associated with handling the complaint, (postage). In the event of withdrawal from the contract due to an error in the goods, the consumer is also entitled to reimbursement of reasonable costs associated with the withdrawal. In the event of an unjustified complaint, the buyer is not entitled to reimbursement of his costs associated with the handling of the complaint and at the same time the seller is not entitled to reimbursement of costs incurred on his part.

Terms of payment

All prices include VAT. All goods are delivered with a tax document (invoice), which is also a warranty card. The goods remain the property of the seller until payment of the purchase price. In the event of cancellation of the order or part thereof by the supplier (eg the goods are sold out), the money or its relevant part is immediately sent back to the account number from which the payment was sent to the seller's account, unless otherwise agreed. The offer (promotional goods, sales and flyer promotions) is valid until stocks are sold out or until further notice. The price is valid at the time of ordering, i.e. sending a binding order.

Payment methods:

When paying by PayPal, AKAT studio reserves the right to check the validity of the PayPal account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. The applicable amount will immediately be reserved on your PayPal account but will not be debited until the goods are dispatched from the warehouse. AKAT studio reserves the right to deny any purchase.
